Terms of Use - Eduplore

Official legal, privacy, compliance, and regulatory documentation for Eduplore (eduplore.in) and the Eduplore mobile application on Google Play Store.

Introduction

These Terms of Use, which are called the Terms in this document, govern your access to and use of the Eduplore learning management system, the Eduplore website at eduplore.in, the Eduplore mobile application available on Google Play Store (https://play.google.com/store/apps/details?id=com.eduplore.app), and all related services, features, video courses, interactive three dimensional STEM labs, quizzes, assessments, progress analytics tools, teacher dashboards, school dashboards, parent dashboards, support channels and communications that form part of Eduplore, which are together called the Services in these Terms.

Eduplore is an Indian learning platform for students in Classes 8, 9 and 10 in Karnataka, and for the parents, guardians, teachers and schools who support those students. The Services offer video courses, interactive three dimensional labs covering subjects such as the Human Body, Heart and ECG, Cell Biology, Periodic Table, Chemistry, Physics, Solar System, Universe and Space, Molecular Biology and Vector Calculus, together with quizzes, practice questions, revision material, progress tracking and learning analytics, in Kannada and in English. The Services are provided for educational purposes, to support learning in line with the school curriculum, to help students understand concepts, to help teachers monitor progress, and to help parents follow their child's learning.

Please read these Terms carefully before you create an account, enrol a student, use a three dimensional lab, watch a video course, attempt a quiz, make a purchase or subscription inside the application, contact support, or otherwise use the Services. By creating an account, by accessing the Services, or by clicking accept where you are asked to accept these Terms, you agree to be bound by these Terms and by the Eduplore Privacy Policy, which forms part of these Terms. If you are a parent or legal guardian, please read these Terms together with your child where appropriate, and you agree to these Terms on behalf of your child where you create an account for your child or consent to your child's use of the Services. If you are a teacher or a school administrator, you agree to these Terms on behalf of yourself, and you confirm that you have authority to act on behalf of your school where you enrol students or enter into a school arrangement with Eduplore.

If you do not agree to these Terms, or if you do not agree to the Privacy Policy, you must not use the Services. If you are under the age of eighteen years, you must have the consent of a parent or legal guardian to use the Services, as described in Section 2 of these Terms. If you are using the Services on behalf of a school, you confirm that you are authorised to bind that school to these Terms, and that the school has obtained any parental consent required for its students.

These Terms are written to comply with Indian law, including the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, the Digital Personal Data Protection Act 2023, the Consumer Protection Act 2019, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021. Where a provision of these Terms refers to a legal requirement, that reference is a summary for information purposes and does not replace the text of the law itself. If any provision of these Terms conflicts with applicable Indian law, applicable law will prevail to the extent of the conflict.

These Terms apply to all users of the Services, whether you are a student, a parent, a legal guardian, a teacher, a school administrator, a school owner or staff member, a visitor to the website, or a person who contacts Eduplore for a demonstration or a trial. Different sections of these Terms apply to different users, and you should read the sections that are relevant to your role. Where a school has entered into a separate written agreement with Eduplore, that agreement will apply in addition to these Terms, and if there is a conflict between that agreement and these Terms on a matter covered by the agreement, the agreement will prevail for that school enrolment.

Eduplore may update these Terms from time to time. When it does, it will revise the last updated date, and where the change is material, it will notify you through the application, by email, or by a notice on the website, as described in Section 21 of these Terms. Continued use of the Services after an update takes effect means that you accept the updated Terms, subject to any consent requirement that applies under applicable law.

2. Acceptance, eligibility and children

2.1. By using the Services, you confirm that you have read and understood these Terms and the Privacy Policy, that you agree to be bound by them, and that you have the legal capacity to enter into this agreement, or, where you are a child, that you have the consent of a parent or legal guardian as described in this Section.

2.2. Eligibility. The Services are intended for students in Classes 8, 9 and 10, and for parents, guardians, teachers and schools who support those students. You must be at least eight years old to use the Services, and if you are below the age of eighteen years, you must have parental consent. There is no upper age limit for a parent, teacher or school administrator who uses the Services in that role, provided that the person is legally capable of entering into an agreement.

2.3. Children and parental consent. A child must not create an account or use the Services without the verifiable consent of a parent or legal guardian, as described in the Privacy Policy. When an account is created for a child, the person creating the account must declare the child's age or date of birth, and must confirm that parental consent has been obtained. Eduplore may seek verifiable consent by sending a verification link, a one time password, or a consent request to the parent's email address or mobile phone number, and may ask the school to confirm that it has obtained parental consent for a school enrolment. If Eduplore learns that a child has created an account without verifiable parental consent, Eduplore may suspend or limit the account until consent is obtained, and may delete the account if consent cannot be obtained within a reasonable time.

2.4. Parent responsibility. A parent or legal guardian who creates an account for a child, or who consents to a child's use of the Services, is responsible for supervising the child's use of the Services, for ensuring that the child understands these Terms, for keeping the child's account credentials confidential, for monitoring the child's learning and screen time, and for any purchase or Subscription made on behalf of the child. A parent should discuss online safety with the child, should encourage the child not to share personal information with strangers through the Services, and should contact Eduplore or the child's school if the parent has a concern about the child's use of the Services.

2.5. School enrolment and parental consent. Where a school enrols a student, the school is responsible for informing parents about the enrolment, about the data that will be shared with Eduplore, and about the purposes for which Eduplore will use that data, and for obtaining parental consent where required. Eduplore will provide the school with a summary of these Terms and of the Privacy Policy and with a consent form template that the school may use. If a parent informs Eduplore that consent was not obtained, Eduplore will suspend processing of that child's data, contact the school, and resolve the matter before resuming the Services for that child, except where processing is required to protect the child or to comply with law.

2.6. Accuracy of information. You confirm that all information you provide to Eduplore is accurate, complete and up to date, and that you will update it promptly if it changes. You must not provide false information about your age, your identity, your class, your school, or your parental status. If you provide false information, Eduplore may suspend or terminate your Account, as described in Section 18 of these Terms.

3. Accounts, passwords and security

3.1. Creating an Account. To use most features of the Services, you must create an Account. You may create an Account through the website or through the mobile application, by providing the information requested at registration, which may include your full name, date of birth or age, class and section, school name, preferred language, Kannada or English, email address, mobile phone number, and a password. A parent, teacher or school may create an Account on behalf of a student, as described in Section 2.

3.2. Account verification. Eduplore may ask you to verify your email address or mobile phone number by entering a one time password or by clicking a verification link sent to that contact. Until verification is complete, your Account may have limited access. You should complete verification promptly, and you should ensure that the contact details you provide are correct and belong to you or, for a child, to the parent or school.

3.3. Passwords. You must choose a strong password, keep it confidential, and not share it with any other person, including another student, a teacher, or a person who claims to be from Eduplore. You must not use the same password that you use for another service where that would increase the risk to your Account. Eduplore will never ask you for your password by email, by phone, or by messaging. If you believe that your password has been disclosed, or that your Account has been accessed without your permission, you must change your password immediately and contact Eduplore.

3.4. Account security. You are responsible for all activity that takes place under your Account, whether that activity is by you or by another person who uses your Account with or without your permission, except where Eduplore is at fault. You should sign out when you use a shared device, such as a family phone, a school tablet, or a computer in a library, and you should not allow another person to use your Account to watch a video, to attempt a quiz, or to access paid Content. If Eduplore detects unusual activity on your Account, such as sign ins from unfamiliar devices or locations, or repeated failed sign in attempts, Eduplore may lock your Account temporarily, may require you to reset your password, or may contact you to verify the activity.

3.5. Keeping information up to date. You must keep your Account information up to date, including your name, class, school, email address and phone number. You can update most details through your Account settings. If you change school, you should update your school information and inform your previous school so that the link to that school can be removed, as described in the Privacy Policy.

3.8. No transfer of Accounts. Your Account is personal to you and must not be transferred, sold, rented, or shared with another person. A parent may manage a child Account on behalf of the child, and a school administrator may manage student Accounts created through that school, but the Account itself remains the Account of the student, and must not be used by another student.

4. Description of the Services

4.1. Video courses. Eduplore provides video courses for Classes 8, 9 and 10, in Kannada and in English, covering subjects in the school curriculum. Video courses include recorded lessons, explanations, diagrams, examples, and revision material. You may watch a video course by streaming it, or by downloading it for offline viewing where that feature is offered. The availability of a video course may depend on your class, your Subscription, or your school enrolment. Eduplore may add, update, or remove a video course from time to time, to improve quality, to correct an error, or to reflect a change in the curriculum.

4.2. Three dimensional labs. Eduplore provides interactive three dimensional labs, including the Human Body three dimensional Atlas, the Heart and ECG Lab, the Cell Lab, the Periodic Table Lab, the Molecular Lab, the Chemistry Lab, the Universe Lab, the Solar System Lab, the Space Lab, the Physics Lab and the Vector Calculus Lab. In a three dimensional lab, you can rotate a model, zoom in and out, explode a model to see its parts, isolate a part, inspect a part, and view labels in Kannada or in English. In the Heart and ECG Lab, you can select a heart rate setting and view a live ECG display for educational purposes. Three dimensional labs are educational tools, and are not medical devices. They are not intended to diagnose, treat, monitor, or provide advice about a health condition, and you should not use them for a medical purpose. If you have a health concern, you should consult a qualified medical professional.

4.3. Quizzes and assessments. Eduplore provides quizzes, practice questions, and assessments to help you test your understanding, to practise for school examinations, and to track your progress. Quizzes may be set by Eduplore, by a teacher, or by a school. Where a quiz is set by a teacher or a school as a formal assessment, the teacher or school may set rules about the number of attempts, the time limit, and whether answers are shown immediately, and Eduplore will apply those rules. Your quiz scores and assessment results will be recorded in your Account and shown in your progress dashboard, and may be shared with your parent, teacher and school as described in the Privacy Policy.

4.4. Progress analytics. Eduplore provides progress analytics that show lesson completion, quiz scores, time spent on a subject, topics mastered, and topics that need revision. Progress analytics are shown to the student, to the parent, to the teacher and to the school in accordance with the Privacy Policy. Progress analytics are intended to support learning, and are not a substitute for a teacher's judgment, for a school examination, or for an official board examination result.

4.5. Teacher and school dashboards. Eduplore provides dashboards for teachers and for school administrators, to help them monitor the progress of students in their class or school, to assign courses and quizzes, and to support learning. A teacher can see the progress of students in a class to which he or she is assigned, and a school administrator can see aggregated progress for the school and individual progress for students enrolled through that school, as described in the Privacy Policy. A teacher or school administrator must use dashboard data only for educational purposes, must not disclose it to an unauthorised person, and must handle it in accordance with the Privacy Policy and with the school's own data protection obligations.

4.6. Parent dashboard. Eduplore provides a dashboard for parents, to help them follow their child's progress, including courses enrolled, lessons completed, quiz scores, and time spent. A parent can see only his or her own child's data, and must not use the dashboard to access the data of another child.

4.7. Offline access. Where the application allows offline access, you may download certain video courses or other Content for offline viewing, subject to your Subscription and to any download limit that Eduplore sets. Downloaded Content is for your personal use only, must not be copied, shared, or transferred to another person or device, and may expire or be removed if your Subscription ends, if your Account is closed, or if the Content is updated or removed from the Services.

5. Schools, teachers and parents

5.1. School enrolment. A school may enrol its students on Eduplore by providing a class list, by using a school code or a classroom link, or by using a bulk enrolment tool. The school is responsible for ensuring that the data it provides is accurate, that it has obtained parental consent where required, and that it informs parents and students about the enrolment, about the data that will be shared with Eduplore, and about the purposes for which Eduplore will use that data, as described in the Privacy Policy and in Section 2.5 of these Terms. The school must not enrol a student without informing the parent, and must not share a student's data with Eduplore where the parent has refused consent.

5.2. School agreement. Where a school enrols students, Eduplore and the school may enter into a separate written agreement that sets out the number of students, the courses and labs included, the duration of access, the responsibilities of each party, the data protection allocation, and any other terms agreed between them. That agreement will apply in addition to these Terms, and if there is a conflict between that agreement and these Terms on a matter covered by the agreement, the agreement will prevail for that school enrolment. A school agreement does not change these Terms for an individual student, parent or teacher, except where the agreement expressly states otherwise and the parent has been informed.

5.3. Teacher responsibilities. A teacher who uses Eduplore must use his or her own Account, must not share Account credentials with students or with another teacher, must use the teacher dashboard only for students in a class to which he or she is assigned, must not disclose a student's progress data to an unauthorised person, must not use student data for a purpose unrelated to teaching, and must report any concern about a student's safety or wellbeing to the school in accordance with the school's safeguarding policy. A teacher must not set a quiz or assessment that requires a student to provide personal data that is not needed for that assessment, and must not ask a student to upload a photograph or other personal data unless that is necessary for the lesson and parental consent has been obtained.

5.4. Parent responsibilities. A parent who uses Eduplore must supervise his or her child's use of the Services, must ensure that the child's Account information is accurate, must keep the child's password confidential, must not allow another child to use the child's Account, must monitor purchases and Subscriptions made on behalf of the child, and must contact Eduplore or the school if the parent has a concern about Content, about a teacher, or about another user. A parent should encourage the child to report any content or message that makes the child feel uncomfortable, and should not use the Services to contact a teacher or another parent for a purpose unrelated to the child's learning.

5.5. School administrator responsibilities. A school administrator who uses Eduplore must ensure that only authorised teachers are given access to the teacher dashboard, must remove access promptly when a teacher leaves the school, must ensure that student Accounts are created only for students enrolled at the school, must inform Eduplore promptly when a student leaves the school so that the link to the school can be removed, and must handle student data in accordance with the Privacy Policy and with applicable law. A school administrator must not use school dashboard data for a purpose unrelated to the management of learning at the school.

6. Acceptable use and prohibited conduct

6.1. You must use the Services only for lawful purposes, only for educational purposes, and only in accordance with these Terms and with the Privacy Policy. You must not use the Services in a way that harms Eduplore, harms another user, harms a child, or violates applicable law.

6.2. You must not engage in any of the following prohibited conduct. You must not use the Services to harass, bully, threaten, abuse, or harm another person, including another student, a teacher, or a parent. You must not use the Services to send or to share content that is obscene, pornographic, sexually explicit, violent, hateful, discriminatory, defamatory, or otherwise unlawful. You must not use the Services to impersonate another person, to create a false identity, or to misrepresent your age, class, school, or parental status. You must not use the Services to cheat in a quiz or assessment, including by sharing answers, by using another person's Account to attempt a quiz, or by using an unauthorised aid where the teacher or school has prohibited it.

6.3. You must not attempt to gain unauthorised access to the Services, to another user's Account, to Eduplore's servers, or to any system connected to the Services. You must not attempt to circumvent a security measure, to bypass an access control, to reverse engineer the application or the three dimensional labs, to extract a three dimensional model or a video file, or to interfere with the operation of the Services. You must not introduce a virus, malware, or other harmful code, and you must not use an automated tool, a bot, a scraper, or a script to access the Services, to download Content in bulk, or to collect data about other users, without the prior written consent of Eduplore.

6.4. You must not use the Services to advertise, to promote a product or service, to send unsolicited messages, or to collect personal data about other users for marketing purposes. You must not use the Services to share a link to a third party website that contains unlawful, harmful, or inappropriate content, and you must not use the Services to encourage another person to engage in prohibited conduct.

6.5. You must not share your Account credentials with another person, must not allow another person to use your Account, and must not use another person's Account. You must not share a Subscription, a paid course, or downloaded Content with another person, and you must not copy, redistribute, or publicly display Content, except as expressly permitted by these Terms.

6.6. You must not upload, submit, or share User Content that is unlawful, that infringes the rights of another person, that contains personal data about another person without that person's consent, that contains a password, a financial detail, or other sensitive personal data, or that is intended to mislead, to deceive, or to harm another person. A child must not upload a photograph of himself or herself, or of another child, without parental consent, and must not share a home address, a phone number, or a school timetable with another user through the Services.

6.7. If you breach this Section, Eduplore may take action as described in Section 18, including warning you, suspending your Account, terminating your Account, removing User Content, or reporting the matter to a school, to a parent, or to a competent authority where required by law. Eduplore may also take action where a teacher or school reports that you have breached a school rule in connection with your use of the Services.

7. Content, intellectual property and licence

7.1. Ownership. All Content provided through the Services, including video courses, three dimensional models, animations, diagrams, questions, quizzes, assessments, explanations, labels, text, images, audio, software, and the design of the website and application, is owned by Eduplore or by its licensors, and is protected by copyright, trademark, and other intellectual property laws in India and in other countries. Nothing in these Terms transfers ownership of Content to you, and you obtain only a limited licence to use the Services as described in this Section.

7.2. Licence to use the Services. Subject to your compliance with these Terms, and subject to any Subscription or school enrolment that applies to you, Eduplore grants you a limited, non exclusive, non transferable, revocable licence to access and use the Services for your personal, non commercial, educational use, in accordance with these Terms. That licence allows you to watch video courses, to use three dimensional labs, to attempt quizzes and assessments, to view your progress, and to download Content for offline viewing where that feature is offered, for your personal use only.

7.3. Restrictions. You must not copy, reproduce, distribute, publicly display, publicly perform, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works from Content, except as expressly permitted by these Terms or by applicable law. You must not extract a three dimensional model, a video file, or a quiz question bank from the Services, must not use Content to create a competing product or service, and must not use Content for a commercial purpose, including by selling, renting, or licensing Content, or by using Content in a tuition centre, a coaching centre, or a school that has not entered into an agreement with Eduplore, without the prior written consent of Eduplore.

7.4. Trademarks. The Eduplore name, logo, and any other trademarks, service marks, or trade names used in the Services are the property of Eduplore or of its licensors, and must not be used without the prior written consent of Eduplore. You must not use a trademark in a way that suggests that Eduplore endorses you, your school, or your product or service, unless Eduplore has agreed in writing.

7.5. Third party Content. Some Content may be provided by a third party licensor, such as a three dimensional model licensor, a video provider, or a content partner. That Content is owned by the licensor, and is licensed to Eduplore for use in the Services. You must respect the rights of that licensor, and must not use that Content in a way that exceeds the licence granted in these Terms. Where Content is based on an open source library or on openly licensed material, Eduplore will retain any attribution and licence notice required by that licence, and you must not remove that attribution.

7.6. Feedback. If you provide feedback, a suggestion, or an idea to Eduplore about the Services, about Content, or about a new feature, you agree that Eduplore may use that feedback without any obligation to you, and without any payment, and that Eduplore may incorporate that feedback into the Services. You must not provide feedback that contains personal data about another person, or that infringes the rights of another person.

7.7. No right to use Content after termination. When your Account is closed, when your Subscription ends, or when your school enrolment ends, your licence to use paid Content ends, and you must stop using that Content, and must delete any downloaded Content from your device, unless Eduplore has agreed otherwise in writing or unless the Content is free Content that remains available to you.

8. User Content

8.1. Responsibility for User Content. You are responsible for all User Content that you create, upload, submit or share through the Services, including notes, bookmarks, answers to quizzes, feedback, questions, messages to support, and any other material that you provide. You confirm that your User Content is accurate, that it does not infringe the rights of another person, that it does not contain personal data about another person without that person's consent, and that it complies with these Terms and with applicable law.

8.2. Licence to Eduplore. By providing User Content, you grant Eduplore a non exclusive, worldwide, royalty free licence to use, store, reproduce, display, and process that User Content, to the extent necessary to provide the Services, to show your progress to you, to your parent, to your teacher and to your school where authorised, to provide customer support, and to improve the Services. That licence ends when you delete the User Content or when your Account is closed, except where Eduplore is required to retain it by law, or where it has been anonymised so that it no longer identifies you.

8.3. No public display. Eduplore will not publicly display your User Content, and will not share your User Content with another user, except where you have asked Eduplore to share it, for example where you share a note with a teacher, or where sharing is necessary to provide the Services, for example where a teacher needs to see a quiz answer to assess it. Eduplore will not use your User Content for advertising, and will not sell your User Content.

8.4. Removal of User Content. Eduplore may remove User Content where it violates these Terms, where it is unlawful, where it is inappropriate for a child, where it contains personal data about another person, or where a parent, teacher, school, or competent authority asks for its removal and Eduplore is satisfied that removal is appropriate. Eduplore will inform you of the removal where it is reasonably practicable to do so, and will explain the reason, unless informing you would prejudice an investigation or would be prohibited by law.

8.5. No obligation to monitor. Eduplore is not required to monitor User Content, but may review User Content where it is reported, where it is necessary to provide support, where it is necessary to investigate a complaint, or where it is necessary to comply with law. Eduplore may use automated tools to detect spam, abuse, or unlawful content, but will not use those tools to monitor a child's learning for advertising purposes.

8.6. Child User Content. Where User Content is created by a child, Eduplore will treat it as personal data of the child, as described in the Privacy Policy, and a parent may ask for its deletion, subject to the retention rules in the Privacy Policy. A child should not include personal data about himself or herself, or about another child, in User Content that is shared with a teacher or with a class, beyond what is necessary for the lesson.

9. Purchases, Subscriptions and refunds

9.1. Paid Content and Subscriptions. Some Content and some features of the Services are available only on payment, through an In App Purchase or a Subscription. The Content and features included in a paid plan, the duration of access, and any limit on the number of devices or downloads, will be described at the time of purchase, in the application or on the website, and in any school agreement that applies. Please read that description carefully before you make a purchase, and ask a parent or teacher if you are unsure whether a purchase is right for you.

9.2. Purchase through Google Play Store. Where you make an In App Purchase or subscribe through Google Play Store, that purchase is processed by Google, and is governed by the terms of Google Play Store, including its payment terms, its Subscription terms, and its refund policy, in addition to these Terms. Eduplore does not process your payment instrument details for a Google Play Store purchase, and does not store full card or bank details, as described in the Privacy Policy. You should read the Google Play Store terms before you make a purchase, and you should manage your Subscription, including renewal and cancellation, through your Google Play Store account settings, unless Eduplore provides a different method in the application.

9.3. Purchase through another payment method. Where Eduplore offers another payment method, such as a payment gateway, a school invoice, or a direct payment, that purchase will be processed by the payment processor or by the school, as described at the time of purchase, and will be governed by the terms of that processor or by the school agreement, in addition to these Terms. Eduplore will provide you with a receipt or a confirmation for a purchase made through Eduplore, and will keep a record of the transaction as described in the Privacy Policy.

9.4. Authorisation for a purchase by a child. A child must not make a purchase or subscribe without the consent of a parent or legal guardian. A parent who allows a child to use a device to make a purchase is responsible for that purchase, and should ensure that the child understands that a purchase involves payment, that the parent has set any parental controls available on the device or on Google Play Store, and that the parent reviews purchase confirmations. If a child makes a purchase without parental consent, the parent should contact Eduplore and Google Play Store promptly, and Eduplore will consider the matter in accordance with its refund policy and with the refund policy of Google Play Store.

9.5. Renewal and cancellation. A Subscription will renew automatically for the same period, unless you cancel it before the renewal date, in accordance with the renewal terms described at the time of purchase and in your Google Play Store account settings. You may cancel a Subscription at any time through your Google Play Store account settings, or through the method described in the application, and cancellation will take effect at the end of the current Subscription period, unless a different arrangement is described at the time of purchase. After cancellation, you will retain access to paid Content until the end of the current period, and will lose access after that period ends, unless you renew.

9.6. Changes to a Subscription. Eduplore may change the Content, features, or duration of a Subscription, or may change the terms on which a Subscription is offered, by informing you in advance, through the application, by email, or by a notice on the website. If a change materially reduces the Content or features included in your Subscription, Eduplore will inform you before the change takes effect, and will explain any refund or credit that applies. You may cancel your Subscription if you do not accept the change, in accordance with Section 9.5.

9.7. Refunds. Refunds for a purchase made through Google Play Store are governed by the refund policy of Google Play Store, and you should request a refund through Google Play Store in the first instance. Refunds for a purchase made through another payment method offered by Eduplore will be considered in accordance with the refund terms described at the time of purchase, and with the Consumer Protection Act 2019. Eduplore will consider a refund where the Content is defective, where access was not provided as described, where a duplicate payment was made, or where a purchase was made by a child without parental consent and the matter is reported promptly. Eduplore will not provide a refund solely because you changed your mind, because you did not use the Content, or because you did not achieve a particular examination result, unless a refund is required by law or is expressly offered at the time of purchase.

9.8. School purchases. Where a school purchases access for its students, the purchase will be governed by the school agreement, including the number of students, the duration of access, the payment terms, and any refund terms agreed in that agreement. A parent should not make a separate purchase for a child who already has access through a school, without checking with the school first, to avoid a duplicate purchase. If a duplicate purchase is made, the parent should contact Eduplore promptly, and Eduplore will consider the matter in accordance with its refund policy.

9.9. Taxes and charges. Any tax, duty, or charge that applies to a purchase will be described at the time of purchase, or will be charged by Google Play Store or by the payment processor in accordance with its own terms. You are responsible for any charge imposed by your bank, by your mobile network operator, or by your internet service provider in connection with your use of the Services, such as data charges for streaming a video course.

10. Free trial, demo and promotional access

10.1. Free trial. Eduplore may offer a free trial of paid Content or of a paid feature, for a limited period, to allow you to try the Services before you subscribe. The duration of a free trial, the Content included, and any limit on use will be described at the time the trial is offered. A free trial is for your personal, non commercial, educational use only, and must not be used to create multiple Accounts to obtain repeated trials.

11. Progress, assessments and examination results

11.1. Progress is indicative. Progress analytics, quiz scores, and assessment results provided through the Services are intended to help you understand your learning, to identify topics that need revision, and to support teaching. They are indicative only, and are not a substitute for a teacher's judgment, for a school examination, or for an official board examination result. Eduplore does not guarantee that a student who uses the Services will achieve a particular score, grade, or examination result.

11.2. Teacher and school assessments. Where a quiz or assessment is set by a teacher or a school, the teacher or school is responsible for the content of that assessment, for the rules that apply to it, for the marking, and for any decision based on its result. Eduplore provides the tool to deliver the assessment and to record the result, but is not responsible for the academic judgment of the teacher or school.

13. Privacy and data protection

13.1. Eduplore collects, uses, stores, shares, protects and deletes personal data in accordance with the Privacy Policy, which forms part of these Terms. By using the Services, you agree to the collection and use of your personal data as described in the Privacy Policy, and, where you are a parent, you agree on behalf of your child where parental consent is required.

13.2. Your responsibilities for data. You must not provide personal data about another person to Eduplore without that person's consent, and you must not provide sensitive personal data through the Services unless Eduplore specifically asks for it for a stated lawful purpose. You must keep your Account credentials confidential, and must not share them with another person, as described in Section 3.

13.3. School data. Where a school provides student data to Eduplore, the school is responsible for ensuring that it has the lawful basis to share that data, including parental consent where required, and for informing parents about the sharing. Eduplore will process school provided data in accordance with the Privacy Policy and with any school agreement.

13.4. Data rights. You have rights in relation to your personal data, as described in the Privacy Policy, including the right to access, to correct, to erase, and to withdraw consent, and the right to raise a grievance with the Grievance Officer. To exercise a right, please follow the procedure in the Privacy Policy.

14. Availability, maintenance and changes to the Services

14.1. Availability. Eduplore aims to keep the Services available, but does not guarantee that the Services will be available at all times, or that they will be uninterrupted or error free. The Services may be unavailable during maintenance, during an update, during a failure of a third party service, during a network failure, or for any other reason beyond Eduplore's reasonable control. Eduplore will endeavour to inform you in advance of planned maintenance, where reasonably practicable, and will endeavour to restore the Services promptly after an interruption.

14.2. Device and internet requirements. To use the Services, you need a compatible device, a supported operating system, the latest version of the Eduplore application where applicable, and an internet connection, except for Content that you have downloaded for offline viewing. You are responsible for ensuring that your device meets those requirements, for keeping your application up to date, and for any data charge imposed by your mobile network operator or internet service provider.

14.3. Changes to the Services. Eduplore may change the Services from time to time, including by adding new courses, new three dimensional labs, new features, or new languages, by improving existing Content, by fixing errors, by changing the design of the application or website, or by removing Content or a feature that is no longer offered. Eduplore will endeavour to inform you of a material change, but is not required to obtain your consent for a change that does not materially reduce the Services you have paid for. If a change materially reduces a paid feature, Eduplore will inform you in advance and will explain any refund or credit that applies under Section 9.

15. Warranties and disclaimers

15.1. Services provided as is. The Services are provided on an as is and as available basis, without any warranty, whether express or implied, except to the extent required by applicable law, including the Consumer Protection Act 2019. Eduplore does not warrant that the Services will be uninterrupted, error free, secure, or free from viruses or other harmful components, that Content will be accurate or complete, or that the Services will meet your particular requirements.

15.2. Educational purpose. The Services are provided for educational purposes only, and are intended to supplement school teaching and textbooks, not to replace them. Eduplore does not provide medical advice, legal advice, or professional advice through the Services. The Human Body Atlas, the Heart and ECG Lab, and any other three dimensional lab that relates to the human body are educational tools only, and are not medical devices, and must not be used to diagnose, treat, monitor, or provide advice about a health condition. If you have a health concern, you should consult a qualified medical professional.

15.3. No warranty for third party services. Eduplore does not warrant the operation, availability, or content of a third party service, including Google Play Store, a payment processor, a hosting provider, or a linked website, and is not responsible for a failure of that service, except to the extent required by law.

15.4. Your use at your own risk. You use the Services at your own risk, and you are responsible for ensuring that your use of the Services is appropriate for your age, class, and learning needs, and, where you are a child, that your parent has consented to your use. A parent should supervise a child's use of the Services, and should ensure that the child does not use the Services for an excessive period, and that the child takes regular breaks.

15.5. Statutory rights. Nothing in these Terms limits a right that you have under applicable law that cannot be excluded, including a right under the Consumer Protection Act 2019. If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.

16. Limitation of liability

16.1. Please read this Section carefully, as it limits the liability of Eduplore to the extent permitted by applicable Indian law. Nothing in this Section limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.

16.2. No liability for indirect loss. To the extent permitted by law, Eduplore will not be liable for any indirect, incidental, consequential, or special loss, including loss of profit, loss of revenue, loss of data, loss of opportunity, or loss of goodwill, arising out of or in connection with your use of the Services, or your inability to use the Services, even if Eduplore was advised of the possibility of such a loss.

16.3. Cap on liability. To the extent permitted by law, the total liability of Eduplore to you, whether in contract, in tort, or otherwise, arising out of or in connection with the Services, will not exceed the total amount paid by you to Eduplore for the Services in the twelve months before the event giving rise to the liability, or, where you have not paid for the Services, the amount that would have been paid for the free Services you used. This cap does not apply to a liability that cannot be limited by law, or to a refund that is required by law.

16.4. No liability for user conduct. Eduplore will not be liable for the conduct of another user, for User Content provided by another user, for a decision made by a teacher or a school based on progress data, or for an examination result, as described in Section 11. Eduplore will not be liable for a loss that arises from your breach of these Terms, from your failure to keep your password confidential, from your use of an incompatible device, or from your failure to follow instructions provided by Eduplore.

16.5. No liability for third party services. Eduplore will not be liable for a loss that arises from the failure, unavailability, or content of a third party service, including Google Play Store, a payment processor, or a linked website, except to the extent required by law.

16.6. Time limit for claims. Any claim arising out of or in connection with the Services must be brought within the time limit prescribed by applicable law, and you should raise a grievance promptly, as described in Section 19, so that Eduplore can investigate it while the relevant records are available.

17. Indemnity

17.1. You agree to indemnify Eduplore, its officers, employees, and agents, against any loss, damage, cost, or expense, including reasonable legal costs, arising out of or in connection with your breach of these Terms, your breach of the Privacy Policy, your misuse of the Services, your User Content, or your violation of applicable law, except to the extent that the loss is caused by the negligence or wilful misconduct of Eduplore.

17.2. If you are a parent, you agree to indemnify Eduplore as described in Section 17.1 for a breach or misuse by your child, to the extent permitted by law, and you confirm that you have explained these Terms to your child and will supervise the child's use of the Services.

17.3. If you are a school, you agree to indemnify Eduplore as described in Section 17.1 for a breach or misuse by the school, by a teacher, or by a student enrolled through the school, where that breach or misuse arises from the school's failure to obtain parental consent, to provide accurate data, or to comply with these Terms or with the school agreement, except to the extent that the loss is caused by the negligence or wilful misconduct of Eduplore.

18. Suspension and termination

18.1. Suspension by Eduplore. Eduplore may suspend your Account, or suspend your access to a feature of the Services, temporarily, where suspension is necessary to protect the security of the Services, to protect a child, to investigate suspected misuse, to investigate a complaint, to comply with a legal obligation, or to enforce these Terms. Eduplore will inform you of the suspension and of the reason, where it is lawful and safe to do so, and will restore access when the issue is resolved.

18.2. Termination by Eduplore. Eduplore may terminate your Account, or terminate your access to the Services, where you have materially breached these Terms, where you have repeatedly breached these Terms, where you have provided false information, where you have engaged in prohibited conduct as described in Section 6, where you have not used your Account for a prolonged period and Eduplore has informed you that it will be closed, or where Eduplore is required to do so by law. Eduplore will inform you of the termination and of the reason, where it is lawful and safe to do so, and will give you a reasonable opportunity to respond, unless immediate termination is necessary to protect a child, to protect the security of the Services, or to comply with law.

18.3. Termination by you. You may close your Account at any time, by contacting Eduplore, or through your Account settings where that feature is available. A parent may close a child Account at any time. A school may ask Eduplore to close student Accounts created through that school, where the school is authorised to do so and parental consent has been obtained where required. Closing your Account will end your access to the Services, and will be handled in accordance with the Privacy Policy, including the deletion of personal data subject to legal retention requirements.

18.4. Effect of termination. When your Account is closed, whether by you or by Eduplore, your licence to use paid Content ends, you must stop using the Services, and you must delete any downloaded Content from your device. Eduplore will delete or anonymise your personal data in accordance with the Privacy Policy, subject to legal retention requirements. Termination does not affect a right or obligation that accrued before termination, including an obligation to pay for a Subscription that has already been provided, or a right to a refund that is required by law.

18.5. No refund on termination for breach. Where Eduplore terminates your Account because you have materially breached these Terms, Eduplore will not provide a refund for the remaining period of a Subscription, unless a refund is required by law. Where you close your Account, any refund will be considered in accordance with Section 9.7 and with the refund policy of Google Play Store or of the payment processor, as applicable.

18.6. School termination. Where a school agreement ends, access for students enrolled through that school will end on the date specified in the agreement, unless the student has a separate individual Subscription or a parent has agreed to continue access. Eduplore will inform the school, and, where reasonably practicable, the parents, before access ends, and will explain how a student can continue to use the Services as an individual user.

19. Grievance redressal, complaints and consumer protection

19.1. Grievance Officer. In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 and the Consumer Protection Act 2019, Eduplore has appointed a Grievance Officer, whose name and contact details are listed in the Contact Information section. The Grievance Officer is responsible for receiving and addressing complaints and grievances relating to the Services, including complaints about Content, about a purchase or Subscription, about an Account, about personal data, or about any other matter relating to the Services.

19.2. How to raise a grievance. You may raise a grievance by writing to the Grievance Officer at the email address given in the Contact Information section, or by using the grievance form in the application or on the website where that form is available, or by contacting support and asking for your matter to be treated as a grievance. Your grievance should state your full name, your contact details, your Account details where relevant, a clear description of the grievance, the date on which the issue arose, and any supporting information. Please do not include your password or full payment instrument details in a grievance. A parent may raise a grievance on behalf of a child, and a school may raise a grievance on behalf of a student where the school is authorised to do so.

19.3. Acknowledgement and resolution. Eduplore will acknowledge a grievance within forty eight hours of receipt, and will endeavour to resolve it within fifteen days, or within such other period as may be required by applicable law. Where a grievance is complex, Eduplore will inform you of the progress and of the expected date of resolution. The Grievance Officer will keep a record of grievances received, of the action taken, and of the outcome, in accordance with the Intermediary Guidelines.

19.4. Complaints about Content. If you believe that Content is inaccurate, inappropriate for a child, infringes your rights, or violates applicable law, you should report it to the Grievance Officer, with details of the Content, the course or lab in which it appears, and the reason for your complaint. Eduplore will review the Content, will take appropriate action, which may include correcting the Content, removing it, or restricting access to it, and will inform you of the outcome where reasonably practicable.

19.5. Consumer rights. Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act 2019, including your right to raise a complaint with a consumer forum, your right to seek a refund where a service is deficient, and your right to be protected from an unfair trade practice. If you believe that Eduplore has provided a deficient service, or has engaged in an unfair trade practice, you may raise a grievance as described in this Section, and, if you are not satisfied with the response, you may approach a consumer forum of competent jurisdiction.

19.6. No retaliation. Eduplore will not retaliate against you for raising a grievance, for exercising a right under these Terms or under the Privacy Policy, or for filing a complaint with a competent authority. If you believe that you have been treated unfairly because you raised a grievance, please inform the Grievance Officer, and Eduplore will investigate the matter.

19.7. Complaints to a competent authority. If you are not satisfied with the response to your grievance, you may file a complaint with the Data Protection Board of India where the complaint relates to personal data, with a consumer forum under the Consumer Protection Act 2019 where the complaint relates to a service or a purchase, or with a court of competent jurisdiction, as described in Section 20.

20. Governing law and dispute resolution

20.1. Governing law. These Terms are governed by the laws of India, including the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, the Digital Personal Data Protection Act 2023, the Consumer Protection Act 2019, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021.

20.2. Informal resolution. Before you file a formal complaint or bring a legal claim, Eduplore encourages you to contact the Grievance Officer as described in Section 19, so that Eduplore can try to resolve the matter informally and promptly. Many disputes can be resolved by clarifying a term, by correcting Content, by restoring access, or by considering a refund, without the need for formal proceedings.

20.3. Jurisdiction. Any dispute arising out of or in connection with these Terms, or with your use of the Services, will be subject to the jurisdiction of the courts in Karnataka, India, unless a different jurisdiction is required by applicable law, or unless the parties agree otherwise in writing. This does not limit your right to file a complaint with the Data Protection Board of India, or to approach a consumer forum under the Consumer Protection Act 2019, which may have jurisdiction in accordance with that Act.

21. Changes to these Terms

21.1. Eduplore may update these Terms from time to time, to reflect changes in the Services, in the law, or in Eduplore's practices. When Eduplore updates these Terms, it will revise the last updated date, and will publish the updated Terms on the website and inside the application.

21.2. Material changes. Where a change is material, for example a change in the licence granted, a change in the Subscription terms, a change in the liability provisions, or a change in the grievance process, Eduplore will notify you before the change takes effect, by email, by an in app notice, or by a notice on the website, and will, where required by applicable law, seek your consent. A material change will not apply to a child's use without fresh parental consent where that is required.

21.3. Non material changes. Where a change is not material, for example a correction of a typographical error, a clarification of wording, or an update to contact details, Eduplore may update these Terms without prior notice, although the updated Terms will still be published on the website and in the application.

21.4. Continued use. Continued use of the Services after updated Terms take effect means that you accept the updated Terms, subject to any consent requirement that applies under applicable law. If you do not accept updated Terms, you should stop using the Services and close your Account as described in Section 18.3, and Eduplore will handle your personal data in accordance with the Privacy Policy.

22. Miscellaneous

22.1. Entire agreement. These Terms, together with the Privacy Policy, and, where applicable, a school agreement, form the entire agreement between you and Eduplore in relation to your use of the Services, and supersede any prior agreement, understanding, or representation, whether oral or written, relating to the Services, except where a prior agreement is expressly preserved in a school agreement.

22.2. Severability. If any provision of these Terms is found to be invalid, illegal or unenforceable by a court or by a competent authority, the remaining provisions will continue in full force and effect, and the invalid provision will be read as narrowly as necessary to make it valid and enforceable, or will be severed if it cannot be so read.

22.3. No waiver. A failure by Eduplore to enforce a provision of these Terms, or a delay in enforcing it, does not mean that Eduplore has waived that provision, or that Eduplore will not enforce it in the future. A waiver of a provision is effective only if it is in writing and signed by Eduplore.
